Osaka Healthcare Pavilion Website Terms of Service

The Osaka Healthcare Pavilion Website Terms of Service ("Terms") set forth matters that users must agree to when using the website provided by the EXPO 2025 Osaka Pavilion Association ("Osaka Pavilion"). Please read these Terms carefully before use as you will be unable to use certain features on the Osaka Healthcare Pavilion website unless you agree to the Terms.
Article 1. (Definitions)
Definitions used in these Terms are as defined in the items below.
- (1)"Service"
Refers to the features and services available on the website provided by Osaka Pavilion (including after any changes in name or content, regardless of reason).
- (2)"User"
Refers to an individual who agrees to these Terms in order to use features of the Service.
- (3)"Reborn Registration Data"
Refers to data registered by the User when using the Service as well as nickname, gender, date of birth, place of residence, and other information required for using the Service deemed necessary by Osaka Pavilion.
- (4)"Data Acquired by Osaka Pavilion"
Refers to the data described in "II. Personal Data Acquired by Osaka Pavilion" in the Privacy Policy separately stipulated by Osaka Pavilion ("Osaka Healthcare Pavilion Privacy Policy"), in addition to the Reborn Registration Data.
- (5)"Intellectual Property Rights"
Refers to copyrights, patent rights, utility model rights, trademark rights, design rights, and other intellectual property rights (including the right to obtain these rights or the right to apply for registration of these rights).
Article 2. (General Provisions and Scope of Application)
- These Terms set forth the basic matters regarding the use of the Service provided by Osaka Pavilion.
- These Terms apply to Osaka Pavilion and Users with respect to the use of the Service.
- Any individual provisions or additional provisions regarding the Service posted by Osaka Pavilion on its website shall constitute part of these Terms. However, these Terms shall take precedence over any individual provisions, additional provisions, or rules that conflict with these Terms unless expressly stated otherwise.
Article 3. (Entry of Reborn Registration Data)
- The User shall enter certain Reborn Registration Data and other Data Acquired by Osaka Pavilion requested by Osaka Pavilion when using the Reborn Experience provided by Osaka Pavilion and certain features of the Service.
- The User must provide true and accurate information when entering Reborn Registration Data and other Data Acquired by Osaka Pavilion. Osaka Pavilion provides the Reborn Experience and the Service based on the Reborn Registration Data and other Data Acquired by Osaka Pavilion entered by the User. Osaka Pavilion assumes no responsibility for any damage incurred by the User due to false data, errors, or omissions in the Reborn Registration Data and other Data Acquired by Osaka Pavilion.
Article 4. (Use of the Service)
- A usage agreement based on the provisions of these Terms is formed between the User and Osaka Pavilion when the User agrees to the Terms of Service through the Service. Minors or adults under guardianship must obtain the consent of their guardian or legal representative ("Legal Representative") if required by law before registering.
- The User may use the Service in accordance with the methods specified by Osaka Pavilion within the scope of the purpose specified in the Terms, provided the User does not violate the Terms.
- The Service may be used on devices capable of using the Service (computers, smartphones, tablets, and other devices necessary for using the Service; the same applies throughout the Terms). The User may use the Service for private use only and may not use it for sales, distribution, development, or any similar purposes.
- The User shall use the Service in the state provided by Osaka Pavilion only and shall not reproduce, modify, alter, adapt, or translate the Service.
- The preparation and maintenance of a device capable of using the Service, as well as software and other equipment, communication lines, and other aspects of the network shall be at the expense and responsibility of the User.
- The User agrees that this Service may be used, in part or in whole, only by Users who meet the conditions deemed necessary by Osaka Pavilion, such as having entered Reborn Registration Data and other Data Acquired by Osaka Pavilion.
- Communication costs related to the use of the Service shall be borne by the User.
- This Service may not be used by those who fall under any of the following categories.
- (1)Members of organized crime groups, persons who have been a member of an organized crime group within the past 5 years, quasi-members of organized crime groups, persons affiliated with organized crime groups, or other antisocial forces ("Organized Crime Group")
- (2)Members of corporations or other organizations whose business activities are controlled by an Organized Crime Group
- (3)Members of corporations whose officers include persons who fall under the category of an Organized Crime Group
- (4)Persons who cooperate with or are involved in the maintenance, operation, or management of an Organized Crime Group through funding or other means, or who have any interaction or involvement with an Organized Crime Group
Article 5. (Prohibited Acts)
The User must not engage in or make a third party engage in any of the following acts when using the Service.
- Acts that violate laws, court decisions or orders, or legally binding administrative measures, or any acts that encourage or may encourage such acts
- Fraud or intimidation against Osaka Pavilion, other users, or a third party
- Acts that are contrary to public order and social standards or that may harm public decency
- Acts that infringe or may infringe upon the intellectual property rights, portrait rights, privacy, reputation, or other rights or interests of Osaka Pavilion, other users, or a third party
- Sending information to Osaka Pavilion through the Service that falls under or is deemed by Osaka Pavilion to fall under any of the following
- ①Information containing violent or cruel expressions
- ②Information containing computer viruses or other harmful programs
- ③Information containing obscene expressions
- ④Information containing expressions that encourage discrimination
- ⑤Information containing expressions that encourage suicide or self-harm
- ⑥Information containing expressions that encourage inappropriate use of drugs
- ⑦Information containing antisocial expressions
- ⑧Information seeking to send to a third party, such as junk mail, spam mail, or chain mail
- ⑨Information containing illegal solicitation, advertising, etc.
- ⑩Information containing expressions that cause discomfort to others
- ⑪Information intended to meet with a stranger
- ⑫Information that violates or may violate the law
- ⑬Information that is contrary to public order and social standards or that may harm public decency
- Reverse engineering
- Acts that place excessive load on the Service's network or system
- Unlawfully accessing systems connected to the Service in general, unlawfully rewriting, deleting, or removing data stored in equipment managed by Osaka Pavilion, or other acts that cause damage to Osaka Pavilion
- Collecting data from other users
- Impersonating Osaka Pavilion, other users, or a third party
- Providing benefits to an Organized Crime Group
- Acts contrary to these Terms, individual terms of use, or the purpose of the Service
- Acts that directly or indirectly trigger or facilitate the preceding items
Article 6. (Changes, Suspension, or Termination of the Service)
- Osaka Pavilion may change, suspend, or terminate all or part of the Service without prior notice to the User.
- Osaka Pavilion may, at its discretion, terminate the provision and operation of all or part of the Service. If Osaka Pavilion decides to terminate the provision and operation of all or part of the Service, Osaka Pavilion will notify the User in a manner it deems appropriate. However, Osaka Pavilion may not notify the User in the event of an emergency.
- Osaka Pavilion may temporarily change, suspend, or terminate all or part of the Service without prior notice to the User in the following events.
- (1)When conducting maintenance or repairing hardware, software, and communication equipment
- (2)When the system is overloaded due to excessive access or other unexpected factors
- (3)When doing so is necessary to ensure User security
- (4)When telecommunication services are suspended
- (5)When Service provision is difficult due to natural disaster or other force majeure
- (6)When Service provision is difficult due to fire, power outage, and other unforeseen accidents as well as war, conflict, civil unrest, riots, labor disputes, etc.
- (7)When laws or legal measures render Service provision impossible
- (8)In the event that the Japan Expo 2025 is canceled, suspended, postponed, etc.
- (9)In other cases similar to the preceding items deemed necessary by Osaka Pavilion
- Osaka Pavilion assumes no responsibility for any damage incurred by the User due to measures taken by Osaka Pavilion under this article.
Article 7. (Attribution of Rights)
- All intellectual property rights in the Service belong to Osaka Pavilion or those who have licensed Osaka Pavilion, and a usage license for the Service does not grant a license to the intellectual property rights of Osaka Pavilion or those who have licensed Osaka Pavilion.
- The User may not adapt, edit, modify, or disclose information provided by Osaka Pavilion without permission nor make a third party do so, nor may the User engage in any acts that infringe or may infringe upon the intellectual property rights of Osaka Pavilion or those who have licensed Osaka Pavilion for any reason (including but not limited to disassembly, decompilation, and reverse engineering).
- Osaka Pavilion does not transfer or license the use of any trademarks, logos, and service marks ("Trademarks") displayed on the Service to the User or any other third party.
Article 8. (Collection, Analysis, and Handling of User Data)
- The User agrees that Osaka Pavilion will handle the Reborn Registration Data and other Data Acquired by Osaka Pavilion in accordance with the Osaka Healthcare Pavilion Privacy Policy.
Article 9. (Compensation for Damages)
- In the event that the User violates the Terms or otherwise causes damage to Osaka Pavilion in connection with the use of the Service, the User shall compensate Osaka Pavilion in full (including fees for attorneys and other experts and an amount equal to Osaka Pavilion's labor costs).
- In the event that Osaka Pavilion receives a claim from other users or third parties for infringement of rights or any other reason in connection with the User's use of the Service, the User shall compensate for the amount Osaka Pavilion was forced to pay to the third party based on the claim and the amount Osaka Pavilion incurred to resolve the dispute related to the claim (including fees for attorneys and other experts and an amount equal to Osaka Pavilion's labor costs).
- Osaka Pavilion shall be liable for ordinary damages only (excluding lost profits and damages arising from special circumstances) in connection with damages suffered by the User in connection to the Service except in cases of willful misconduct or gross negligence on the part of Osaka Pavilion.
Article 10. (Disclaimer or Guarantee and Exemptions)
- Osaka Pavilion does not guarantee that the Service or any other services or information the User may use or obtain in connection with the use of the Service is suitable for the User's specific purposes; has the features. commercial value, accuracy, usefulness, or completeness expected by the User; complies with the law or internal rules of industry associations applicable to the User; is free from defects; nor any other matters.
- Osaka Pavilion does not guarantee that the Service is compatible with all devices, and the User acknowledges in advance that, even if the Service was compatible at the time of initial use, malfunctions may occur in the operation of the Service due to subsequent OS version upgrades to their device. Osaka Pavilion does not guarantee that such malfunctions will be completely resolved by program fixes made by Osaka Pavilion.
- Osaka Pavilion does not, in principle, intervene in communication or activity between Users. The Users shall resolve any disputes or problems between Users at their own responsibility and expense, and Osaka Pavilion shall not be involved in any way nor bear any liability.
- In the event of a dispute between a User and a third party regarding the Service, the User shall immediately notify Osaka Pavilion and resolve it at their own responsibility and expense, and Osaka Pavilion shall not be involved in any way or bear any liability/
Article 11. (Effective Period)
These Terms remain valid between Osaka Pavilion and the User during the Service provision period from the date that registration procedures on the Service are completed until the date Osaka Pavilion ceases to provide the Service.
Article 12. (Revision of Terms)
Osaka Pavilion may change the content of these Terms by posting on the Service or other methods deemed appropriate by Osaka Pavilion in any of the following cases, and the changes shall apply from the date of change.
- (1)When the change to these Terms is in the general interest of the User
- (2)When the change to these Terms does not contradict the purpose of these Terms and is reasonable in terms of necessity, appropriateness, and content after the change as well as any other circumstances pertaining to the change
Article 13. (Communication and Notification)
- Notifications regarding changes to these Terms and other communications from Osaka Pavilion to the User regarding the Service shall be made by posting in an appropriate location on the Osaka Healthcare Pavilion website or other methods deemed appropriate by Osaka Pavilion.
- Inquiries regarding the Service and other communications or notifications from the User to Osaka Pavilion shall be made by calling the dedicated telephone number, using the inquiry form established in an appropriate location on the Osaka Healthcare Pavilion website, or other methods specified by Osaka Pavilion.
Article 14. (Transfer of Status Under These Terms)
The User may not transfer their status under these Terms or any rights and obligations based on these Terms, in part or in whole, to a third party nor use these as collateral without the prior written consent of Osaka Pavilion.
Article 15. (Severability)
If any provision or portion of these Terms is deemed invalid or unenforceable by law, the remaining provisions and the remainder of the provision deemed partially invalid or unenforceable shall remain in full effect, and Osaka Pavilion and the User shall endeavor to modify the invalid or unenforceable provision or portion of the provision to the extent necessary to make it lawful and enforceable and ensure the intent and legally/economically equivalent effect of the invalid or unenforceable provision or portion.
Article 16. (Surviving Provisions)
The provisions of Article 6, Paragraphs 2 and 4, Articles 7 to 10, and Articles 13 to 17 shall survive the termination of the use of the Service.
Article 17. (Governing Law and Agreed Jurisdiction)
The Terms shall be governed by Japanese law, and the Osaka District Court shall have exclusive jurisdiction court of first instance for any dispute arising from the Terms.
Supplementary Provisions
These Terms are effective as of February 1, 2025.
